Guidelines for Preventing Health Impairment by Chemical Substances with Mutagenicity Recognized

1. Purport
The present guidelines prescribe the matters to be considered in manufacture or handling of a chemical substances on which strong mutagenicity was recognized (hereinafter called the "mutagenic chemical substances") on the basis of the results of mutagenicity tests using microorganisms, chromosomal aberration studies using cultured mammalian cells, etc. or a product that contains the mutagenic chemical substances (excluding those containing 1% or less by weight of the mutagenic chemical substances) (hereinafter called the "mutagenic chemical substances, etc.") in order to prevent workers' health impairment by the exposure to the relevant mutagenic chemical substance with respect to the work for manufacture or handling of the mutagenic chemical substances, etc. The employer shall strive in taking appropriate measures for preventing workers' health impairment in addition to taking measures prescribed in the present guidelines.

2. Measures for Reducing Exposure to Mutagenic Chemical Substances
(1) In order to reduce workers' exposure to the mutagenic chemical substances, following measures related to the work environment management, measures related to work management, and other necessary measures shall be taken as required in consideration of properties of the mutagenic chemical substances, etc. in the relevant workplace, manufacturing amount, handling amount, frequency of the work, working time, mode of work, etc.
a Work environment management
(a) Changes in conditions of use, etc.
(b) Improvements in operation process
(c) Making the equipment closed
(d) Installation of local exhaust ventilation equipment, etc.
b Work management
(a) Selection of work position, work posture, or work method that prevent workers from being exposed to the mutagenic chemical substances
(b) Use of protective equipment such as respirators, impermeable protective clothes, protective gloves, etc.
(c) Shortening of time in which workers are exposed to the mutagenic chemical substances
(2) When apparatus, etc. for reducing the exposure are installed in compliance with Paragraph (1), the following shall be abided by.
a to properly operate the local exhaust ventilation equipment, etc. while the work is being carried out
b to periodically carry out maintenance and inspection of the local exhaust ventilation equipment, etc.
c to prevent contamination of the workplace by exhaust, waste liquid, etc. containing the relevant substances, in case the mutagenic chemical substances, etc. is discharged to the outside of the worksite
d to equip with the protective equipment in a quantity greater than number of workers simultaneously engaged in the work and to keep them constantly effective and clean. And to take necessary measures to prevent the relevant workers from inhaling hazardous air, in case supplied-air respirators are used
(3) With respect to the following works, the work rules shall be established and the workers shall be instructed to carry out the work in compliance with the work rules.
a Operation, adjustment, and inspection of the equipment, apparatus, etc.
b Emergency measures, in case of occurrence of any extraordinary condition
c Use of protective equipment

3. Measurement of Work Environment
(1) When the work related to the mutagenic chemical substances are carried out indoors and the technique for measuring the work environment concerning the relevant substance has been developed, it is recommended to periodically measure the work environment in reference to the work environment measurement standard, work environment guidebooks, etc. in accord with the properties of the relevant substances.
(2) Efforts should be made to retain the work environment measurement results and the record of evaluation results for 30 years.

4. Industrial Health Education
(1) Workers engaged in a work for manufacturing or handling the mutagenic chemical substances, etc. or assigned to engage in such work shall be provided with the industrial health education with respect to the following matters.
a Properties and toxicity of the mutagenic chemical substances
b Health impairment caused by the mutagenic chemical substances, preventive method and emergency measures for the impairment
c Local exhaust ventilation equipment and other facilities for reducing exposure to the mutagenic chemical substances and method of maintenance and inspection of them
d Kind, performance, usage and maintenance of the protective equipment
(2) Time for the industrial health education related to the matters mentioned above shall be 4 hours or more.
(3) For the worker recognized to possess sufficient knowledge and skills on the whole or part of the matters specified in Items a. through d. of Paragraph (1), the education on the relevant items may be omitted.

5. Labelling of Hazard, etc.
In compliance with the "Guidelines concerning Labelling of Hazard Etc. of Chemical Substances, Etc." (ML Notification No. 60, 1992), such necessary measures shall be taken as supplying safety data sheets for chemical substances, etc. and labelling containers and packages, etc., if the mutagenic chemical substances, etc. are transferred or supplied.

6. Grasping of Workers Engaged in Manufacture, Etc. of Mutagenic Chemical Substances, Etc.
Following items shall be recorded for each period not exceeding 1 year for each worker constantly engaged in the work for manufacturing or handling the mutagenic chemical substances, etc.
a Name of the worker
b Outline of the work engaged in and period during which the worker was engaged in the relevant work
c Outline of the state in which the worker is markedly contaminated with the mutagenic chemical substances, should such condition occur, and outline of the emergency measures taken
Efforts shall be made to retain the records of the above-mentioned matters for 30 years from the date when the relevant worker begins to engage in the relevant work at the relevant workplace.
