Chapter I.  Individual Examination

(Application for Individual Examination, etc.)

Article 1.   A person who intends to undergo an examination provided by the provisions of paragraph 1 or 2 of Article 44 of Industrial Safety and Health Law (hereinafter referred to as the "Law"), (hereinafter referred to as "individual examination") shall submit application for an individual examination (Form No.1) together with the following drawings and documents per each machine, etc., that is to be subjected to the said individual examination to a person who carries out individual examination (hereinafter referred to as "individual examination practitioner"):

(1)  Structural drawings of machines, etc., that is to be subjected for individual examination.

(2)  Detailed specifications as per Form No. 2

2.   Of those who wish to undergo the individual examinations, one who has imported or manufactured in a foreign country the machines, etc., to undergo the individual examination may attach the document, which is to be issued by the party designated by the Minister of Health, Labour and Welfare (restricted to the party residing in the foreign country concerned) to certify that the machines, etc., concerned are in conformity with the standards designated by the Minister of Health, Labour and Welfare in compliance with the provision of Article 42 of the law to the application set forth in the preceding paragraph.

3.   A person who has made an application in accordance with the provisions of the preceding paragraph (hereinafter referred to as "individual examination applicant") shall make preparations necessary for undergoing individual examination.

Article 2.  The individual examination shall be carried out at the place where the individual examination applicant desires to undergo the examination.

(Individual Examination Standards)

Article 3.  The standards prescribed by Ministry of Health, Labour and Welfare Ordinance under the provision of paragraph 3 of Article 44 of the Law shall be the standards as specified by the Minister of Health, Labour and Welfare based on the provision of Article 42 of the Law.

Article 4.  An individual examination practitioner shall deliver the detailed specifications provided by the provisions of item 2 of paragraph 1 of Article 1, affixed with a seal indicating the fact of having passed the individual examination to the individual examination applicant with respect to the machines, etc., which have passed the individual examination.

Article 5.  A person who has undergone individual examination for the machines, etc., prescribed in item 2 of Article 13 of Enforcement Order of Industrial Safety and Health Law (Cabinet Order No. 318 of 1972 hereinafter referred to as the "Cabinet Order") shall affix an emblem indicating the fact of having passed the individual examination (Form No. 4) to an easily visible portion of the machines, etc., which has passed the said individual examination, but restricted to the machines, etc., equipped with electrical control systems for emergency stop as prescribed by the said item.

2.  An individual examination practitioner shall stamp a carved seal as per Form No. 5 or affix a nameplate stamped with a carved seal as per the said Form to an easily visible portion of the machines, etc., described in item 8, 23, and 24 of Article 13 of the Cabinet Order, which has passed the individual examination.
