The Safety Ordinance for Gondola

(Ordinance of the Ministry of Labour No.35 September 30, 1972)

Chapter III Use and Operation

Article 11 (Limitation of Use)
  • (1) The employer shall not use a gondola unless it complies with the standards (limited to the structural parts of the gondola) provided for by the Minister of Health, Labour and Welfare set forth in paragraph (2) of Article 37 of the Act.
Article 12 (Special Education)
  • (1) The employer shall, when placing a worker in operation of a gondola, conduct the special education for the safety related to the said operation, to the said worker.
  • (2) The special education set forth in the preceding paragraph shall be conducted as to the following subjects:
    • (i) Knowledge on a gondola;
    • (ii) Knowledge on the electricity necessary for gondola operation;
    • (iii) Related legislation;
    • (iv) Operation and checkup of a gondola;
    • (v) Signals for operation of a gondola.
  • (3) In addition to the matters prescribed in Article 37 and Article 38 of the Safety and Health Ordinance and in the preceding two paragraphs, the Minister of Health, Labour and Welfare shall prescribe necessary matters related to the special education set forth in paragraph (1).
Article 13 (Limitation of Overloading)
  • (1) The employer shall not use a gondola being loaded with the load exceeding its loading capacity.
Article 14 (Prohibition of Use of Stepladder, etc.)
  • (1) The employer shall not have workers work on a working floor of the gondola using a stepladder, a ladder, etc.
Article 15 (Prohibition of Leaving Gondola Unattended)
  • (1) The employer shall not have a gondola operator leave the operating station, while the said gondola is being used.
  • (2) The operator set forth in the preceding paragraph shall not leave the operating station, while a gondola is being used.
Article 16 (Signals for Operation)
  • (1) The employer shall, when carrying out the work using a gondola, set the fixed signals for the operation of the gondola, designate a person who gives the said signals and have the said person give the said signals. However, this shall not apply to when having only a gondola operator carry out the work by single-handedly.
  • (2) The person designated pursuant to the preceding paragraph, when engaging in the work set forth in the same paragraph, shall give the signals set forth in the same paragraph.
  • (3) Workers engaged in the work using a gondola shall follow the signals set forth in paragraph (1).
Article 17 (Safety Belt, etc.)
  • (1) The employer shall, when carrying out the work on a working floor of a gondola, have workers engaged in the said work use the safety belt (meaning the safety belt set forth in item (xxviii) of paragraph (3) of Article 13 of the Order) or other life lines (hereinafter referred to as gsafety belt, etc.h in this Article.).
  • (2) As regards a gondola equipped with one wire rope for suspending the gondola, the safety belt, etc. set forth in the preceding paragraph shall be fitted with the one other than the said gondola.
  • (3) The worker shall, when being indicated to use a safety belt, etc. in the case referred to in paragraph (1), use it.
Article 18 (Prohibition of Entrance)
  • (1) The employer shall prohibit persons other than workers concerned to enter without reason under the place where the work using gondola is being carried out, and display a notice to that effect at a readily visible location.
Article 19 (Prohibition of Work in Bad Weather)
  • (1) The employer shall, when dangers regarding the implementation of work using a gondola are forecast due to the bad weather such as the strong wind, heavy rain, heavy snow, etc., suspend the said work.
Article 20 (Illumination)
  • (1) The employer shall, as regards the place where the work using gondola is to be carried out, maintain the necessary illumination for carrying out the said work safely.
