1. Safety and Health Management System


An effective safety and health management system is essential in carrying out continuous and effective safety and health activities. In particular, the following conditions are legally required to effectively implement safety and health management systems in terms of the size and sector of workplaces

By way of reference, the Industrial Safety and Health Law is not applied to an entire company organization but to individual workplaces such as plants, branch offices and work sites where production activities are independently carried out. In addition, employers mean corporations themselves in the case of companies, and entrepreneurs in the case of self-employed businesses.

(1)Safety and Health Management System in the Manufacturing Industry, Etc.

[Basic System]

(2)Workplaces where supervisors, etc., should be appointed

1.

General safety and health supervisor-Soukatsu-anzen-eisei-kanrisya

(a)

Workplaces employing 100 or more workers in the following industries:

Forestry, mining, construction, transportation and cleaning

(b)

Workplaces employing 300 or more workers in the following industries

Manufacturing, electricity, gas, heat supply, waterworks, communications, wholesaling of various goods, wholesaling of furniture, fixtures and household goods, retailing of various goods, retailing of furniture, fixtures and household goods, retailing of fuels, hotels, golf courses, automobile servicing and mechanical servicing

(c) All workplaces with 1,000 or more workers

Industrial physician-Sangyo-i

All workplaces with 50 or more workers

3.

Safety supervisor-Anzen-kanrisya

All workplaces employing 50 or more workers in industries under (a) and (b) above

4.

Safety and health promoter-Anzen-eisei-suishinsya

All workplaces employing from 10 to 49 workers in industries under (a) and (b) above

5.

Health supervisor-Eisei-kanrisya

All workplaces employing 50 or more workers

6.

Health promoter-Eisei-suishinsya

All workplaces employing from 10 to 49 workers in industries under (a) and (b) above, excluding workplaces specified in _

7.

Operations chief-Sagyo-syuninsya

Workplaces at which dangerous or hazardous operations are carried out, including operations in high pressure workplaces (31 types of operations in total)

8.

Overall safety and health controller -Toukatsu-anzen-eisei-sekininsya
(shipbuilding and construction sites where subcontractors are used)

Shipbuilding yards employing 50 or more workers, including subcontractor employees

Tunnel and bridge construction sites and other sites using compressed air employing 30 or more workers including subcontractor employees

*

Construction worksites other than above employing 50 or more workers including subcontractor employees

9.

Safety and health controller-Anzen-eisei-sekininsya

All subcontractor workplaces in shipbuilding yards and construction sites where an overall safety and health controller is appointed



(3)Major Responsibilities and Qualifications of Supervisors, Etc.

1.

General safety and health supervisor-Soukatsu-anzen-eisei-kanrisya

Directing work of safety supervisors and health supervisors

Overall supervision of measures to prevent dangerous or health-impairing hazards, implementing safety and health education, implementing medical examinations, supervising measures to promote health maintenance, surveying accident causes and implementing measures to prevent recurrences

[Qualifications]

Personnel responsible for overall workplace operations (i.e., plant manager or branch manager)

Industrial physician-Sangyo-i

[Major responsibilities]

Management of taking health care for workers

Implementing medical examinations for workers, maintaining and improving worker health, maintaining and controlling working environments, controlling work operations, health education and health consultation, medical education, surveying the causes of health impairment and other responsibilities relating to the prevention of recurrences

[Qualifications]

Medical or dental practitioners and those who have been qualified by industrial health consultant examinations in the field of hygiene and health

Safety supervisor-Anzen-kanrisya

[Major responsibilities]

Technical matters relating to safety among the responsibilities of general safety and health supervisors

Workplace patrol

[Qualifications]

Those who have completed regular university-level science or engineering courses and have actual work experience in the field of industrial safety

Safety and health promoter-Anzen-eisei-suishinsya

[Major responsibilities]

Technical matters similar to those of safety supervisors and health supervisor

[Qualifications]

Those who are recognized by the employer as having the capability to carry out the above responsibilities

5.

Health supervisor-Eisei-kanrisya

[Major responsibilities]

Technical matters relating to health among the responsibilities of general safety and health supervisor

Workplace patrol

[Qualifications]

Medical or dental practitioners, industrial health consultants and those who have been qualified by health supervisor license examinations

6.

Health promoter-Eisei-suishinsya

[Major responsibilities]

Technical matters similar to those of health supervisor

[Qualifications]

Those who are recognized by the employer as having the capability to carry out the above responsibilities

7.

Operations chief-Sagyo-syuninsya

[Major responsibilities]

Command of dangerous or hazardous operations

[Qualifications]

Those who have been qualified by operations chief licensing examinations or who have completed skill training courses designated by the director of the pertinent prefectural labour standards bureau

8.

Overall safety and health controller-Toukatsu-anzen-eisei-sekininsya

[Major responsibilities]

Prevention of industrial accidents for all workers including subcontractor employees

Overall supervision and coordination of operations in construction/shipbuilding sites, including establishing and operating consulting organizations among contractors and subcontractors, harmonizing and coordinating various operations, making workplace patrol, providing guidance and assistance to worker education by related contractors and planning work process coordination

[Qualifications]

Those responsible for the overall direction and management of the relevant work site (i.e., work site manager)

9.

Safety and health controller-Anzen-eisei-sekininsya

[Major responsibilities]

Maintaining close contact with the overall safety and health controller, providing instructions to related contractors, implementing instructions, and confirming the existence of dangerous conditions at work sites

[Qualifications]

Those who have the capability to carry out the above responsibilities
