35. Authorized agencies for inspection
at the time of manufacture, etc.


The Industrial Safety and Health Law stipulates that various inspections for ensuring the safety of specified machines and other equipment, such as boilers and cranes, examinations of dust respirators, etc., skill-training courses for persons engaged in hazardous and harmful operations, etc. should be carried out by the Minister of Health, Labour and Welfare, the Director General of Prefectural Labour Bureau concerned, and the Chief of the competent Labour Standards Inspection Office concerned. However, the authorized agencies designated by the Minister of Health, Labour and Welfare, etc. can also carry out these inspections.
The authorized agency designation requirements, etc. are stipulated in the Ordinance on Authorized Agencies for Inspection at the Time of Manufacture, etc. (The Industrial Safety and Health Law, and the Ordinance on Authorized Agencies for Inspection at the Time of Manufacture, etc.)
1. Types of authorized agencies to be designated, and designators
The types of authorized agencies to be designated (registered in the case of inspection agencies) and designators are as follows, and those designated are publicly announced, except those listed as e. and h.:
a Authorized agencies for inspection at the time of manufacture, etc. (Law, Articles 46 to 53; Ordinance, Article 1-3)
Authorized agencies that carry out the structure inspections of boilers (waste heat boilers)
Designator: Minister of Health, Labour and Welfare
b Authorized agencies for performance inspections (Law, Article 53-2)
Authorized agencies that carry out the performance inspections of specified machines and other equipment, such as boilers and cranes
Designator: Minister of Health, Labour and Welfare
c Authorized individual examination agencies (Law, Article 54)
Authorized agencies that carry out the individual examinations of second class pressure vessels, small size boilers, etc.
Designator: Minister of Health, Labour and Welfare
d Authorized agencies for type verification tests (Law, Article 54-2)
Authorized agencies that carry out the type verifications of dust respirators, hard hats, etc.
Designator: Minister of Health, Labour and Welfare
e Registered Inspection agencies (Law, Articles 54-3 to 54-6)
Agencies that inspect machines and other equipment at the request of a specific, qualified person (special voluntary inspection), among the machines and other equipment to be periodically voluntarily inspected
Designator: Director General of the Prefectural Labour Bureau concerned (Minister of Health, Labour and Welfare in the case where operations are performed in plural prefectures.)
f Designated testing institutions (Law, Articles 75-2 to 75-12)
Institutions that carry out license examinations
Designator: Ministry of Health, Labour and Welfare
g Designated consultant examination institutions (Law, Article 83-3)
Institutions that carry out industrial safety and health consultant examinations (the same institution as f.)
Designator: Minister of Health, Labour and Welfare
h Designated training institutions (Law, Article 77)
Institutions that give courses to operations chiefs and persons in need of skill-training courses for restricted work, and institutions that give practical training courses for license examinations (trainees are exempted from practical tests)
Designator: General Director of the Prefectural Labour Bureau concerned
i Designated registration agencies (Law, Article 85-3)
Agencies that register industrial safety and health consultants
Designator: Minister of Health, Labour and Welfare
2. Designation standards (outline)
a. Authorized agencies for inspections at the time of manufacture, etc. and authorized agencies for performance inspections (Ordinance, Articles 1-4 and 4)
· The agency is to be a juridical person
· There should be a chief inspector with specific qualifications and the required number of inspectors with specific qualifications.
· There should be the required number of inspection instruments.
· Technical investigations, research, etc. should be possible.
· There must be a financial foundation.
b. Authorized individual examination agencies and authorized agencies for type verification tests (Ordinance, Articles 13 and 19-5)
· The agency is to be a juridical person
· There should be a chief examiner with specific qualifications and the required number of examiners with specific qualifications.
· There should be the required number of examination instruments.
· Technical investigations, research, etc. should be possible.
· There must be a financial foundation.
c. Registers Inspection Agencies (Ordinance, 19-23)
· There should be the required number of persons with specific qualifications to adequately carry out special voluntary inspections.
· There should be the required number of inspection instruments.
· There should be regulations that stipulate the inspection fee collection method, etc.
d. Designated testing institutions, designated consultant examination institutions, and designated registration agencies (Ordinance, Articles 19-25 to 19-37, 26 to 37, and 39 to 51)
The Minister of Health, Labour and Welfare designates the testing institutions and consultant examination institutions, but no particular designation standard has been established.
e. Designated training institutions (Ordinance, Article 22)
· The institution is to be a juridical person
· There should be an operations manager with specific qualifications.
· There should be instructors and skill examiners with specific qualifications.
· There should be machines, equipment, etc. necessary for the training courses.
· If the persons who have been practically trained undergo the practical tests given by the Director General of the Prefectural Labour Bureau concerned (or completion tests for the initial practical training given by the designated training institution), 95% or more of these persons should pass the tests
· There should be regulations that stipulate the inspection fee collection method, etc.

The names of designated agencies and institutions are publicly announced in notifications from the Ministry of Health, Labour and Welfare.

c. Authorized examination agencies
· Individual examinations
: Emergency stop equipment for rolling mills for rubber, etc.: Technology Institution of Industrial Safety
: Secondclass pressure vessels, small size boilers, small size pressure vessels: Japan Boiler Association and Boiler & Crane Safety Association
: Overload preventive devices for cranes or mobile cranes: Japan Crane Association
· Type verification: Technology Institute of Industrial Safety
d. Authorized testing institutions and consultant examination institutions: The Institute for Safety and Health Qualifying Examination
e. Designated registration agencies: The Japan Industrial Safety and Health Consultant Association
