Enforcement Order of the Working Environment Measurement Law

(Designated Workshops)

Article 1.  A workshop to be designated by Cabinet Order on the basis of item 3 of Article 2 of the Working Environment Measurement Law (hereinafter referred to as "the Law") shall be as follows:

(1)  Workshops listed in items 1, 7, 8, and 10 of Article 21 of the Enforcement Order of Industrial Safety and Health Law (Cabinet Order No. 318 of 1972).

(2)  Workshops designated by Ministry of Health, Labour and Welfare Ordinance from among the workshops listed in item 6 of Article 21 of the Enforcement Order of Industrial Safety and Health Law.

(Fees)

Article 2.  The amounts of fees to be fixed by Cabinet Order as provided for in paragraph 1 of Article 49 of the Law shall be, in accordance with the classification of persons listed in the following items, fixed as in the corresponding items:

(1)  A person who falls under item 1 of paragraph 1 of Article 49 of the Law: in accordance with the classification of a person listed in a) or b), the amount fixed in a) or b) respectively.

a) A person who intends to take the Class-1 working environment measurement expert test: 13,900 yen (10,600 yen in the case all specified subjects (hereinafter in this item referred to as "specified subjects") determined by the Ministry of Health, Labour and Welfare Ordinance are exempted), provided that, where the number of the subjects of test other than the specified subjects is in excess of one, the amount calculated by adding 3,300 yen for each of the exceeding number of subjects.

b) A person who intends to take the Class-2 working environment measurement expert test: 11,800 yen.

(2)  A person who falls under item 2 of paragraph 1 of Article 49 of the Law: 22,600 yen for each of the applications for designation under the same item.

(3)  A person who falls under item 3 of paragraph 1 of Article 49 of the Law: amount to be fixed by Cabinet Order elsewhere.

(4)  A person who falls under item 4 of paragraph 1 of Article 49 of the Law: in accordance with the classification of persons listed in a) or b), the amount fixed in a) or b) respectively.

a) A person who intends to obtain registration under Article 7 of the Law: 25,800 yen for each application for registration under the same Article.

b) A person who intends to obtain registration under Article 33 of the Law: 43,000 yen for each of the applications for registration under the same Article.

(5)  A person who falls under item 5 of paragraph 1 of Article 49 of the Law: in accordance with the classification of persons listed in a) or b), the amount fixed in a) or b) respectively.

a)  Reissue and renewal of working environment measurer registration certificate.For the reissue or renewal of the registration certificate, 3,450 yen shall be charged per case.

b)  Reissue and renewal of working environment measurement agency registration certificate. For the reissue or renewal of the registration certificate of the working environment measurement agency, 2,450 yen shall be charged per case.

(6)  A person who falls under item 6 of paragraph 1 of Article 49 of the Law: in accordance with the classification of persons listed in a) or b), the amount fixed in a) or b) respectively.

a) A person who intends to obtain the reissue of his certificate: 1,600 yen for each application for reissue of the certificate.

b) A person who intends to obtain the reissue of his certificate of completion of the training course conducted by the Director General of the Prefectural Labour Bureau: amount to be fixed by Cabinet Order elsewhere.

Article 3.  The fees under the provisions of paragraph 1 of Article 49 of the Law shall be paid by attaching a revenue stamp to the application, the amount of which corresponds to the said amount of the fee, provided that the fees which are paid by the person shall be paid according to the provisions of each of the following items:

(1)  Those who wish to take the examination to be given by a designated testing institution (hereinafter referred to as "designated testing institution") provided for in paragraph 2, Article 20 of the Law or those who wish to ask for the reissue of the successful applicant certificate shall conform to the regulations for the examination procedure provided for in paragraph 1, Article 25 of the Law.

(2)  Those who wish to be registered with the designated registration institution (hereinafter referred to as "designated registration institution") provided for in paragraph 2, Article 32-2 or those who wish to have their working environment measurement registration certificates reissued or renewed shall conform to the regulation for the registration procedure provided for in paragraph 1, Article 25 of the Law, which is applicable with the necessary modification to the case provided for in paragraph 4 of the said article.

2.  The fees under the preceding paragraph shall not be reimbursed once they are paid.
