8. Inspections, Investigations
and Recordkeeping
|
(a) 長官は本法の目的を遂行するため、所有者、使用者、又は有責代理人に適切な証明書を提示することにより、以下の事項を行う権限を有する。
|
|
(a) In order to carry out the purposes of
this Act, the Secretary, upon presenting appropriate credentials to the
owner, operator, or agent in charge, is authorized -
|
(1) ある事業者の労働者が作業を行っているあらゆる工場、プラント、施設、建設現場、その他の地域・作業場・環境に、遅滞なく、妥当な時間に立ち入る。

(1) to enter without delay and at reasonable
times any factory, plant, establishment, construction site, or other area,
workplace or environment where work is performed by an employee of an
employer; and
|
(2) あらゆるそれらの雇用の場所、すべての関連する条件、構造、機械、装置、器具、機器、材料などを、正規の就業時間内その他妥当な時間内に、妥当な限度と妥当な方法によって検査、調査し、それらの事業者、所有者、使用者、代理人、労働者に個別に質問する。

(2) to inspect and investigate during regular
working hours and at other reasonable times, and within reasonable limits
and in a reasonable manner, any such place of employment and all pertinent
conditions, structures, machines, apparatus, devices, equipment, and materials
therein, and to question privately any such employer, owner, operator,
agent or employee.
|
(b) 長官は本法に基づく検査及び調査を行うに当たって、証人の立ち会いと証言を求め、誓約の下での証拠の提出を求めることができる。証人にはアメリカ合衆国裁判所の証人に対するものと同額の報酬とマイル当たり旅費が支払われる。かかる命令に服従せず、又はそれを履行せず、拒否した者に対しては、その者が居住する又は事業を営む場所のアメリカ合衆国地方裁判所、又はあらゆる領土又は領地のアメリカ合衆国裁判所が、長官の申請に基づいて、出頭し、証拠を提出することを要求する命令を与え、その命令が与えられた際には、調査中の問題について証言することを命じる権限を有するものとする。かかる裁判所命令に従わなかった場合には、法定侮辱罪として処罰されることがある。

(b) In making his inspections and investigations
under this Act the Secretary may require the attendance and testimony
of witnesses and the production of evidence under oath. Witnesses shall
be paid the same fees and mileage that are paid witnesses in the courts
of the United States. In case of a contumacy, failure, or refusal of any
person to obey such an order, any district court of the United States
or the United States courts of any territory or possession, within the
jurisdiction of which such person is found, or resides or transacts business,
upon the application by the Secretary, shall have jurisdiction to issue
to such person an order requiring such person to appear to produce evidence
if, as, and when so ordered, and to give testimony relating to the matter
under investigation or in question, and any failure to obey such order
of the court may be punished by said court as a contempt thereof.

(c)(1) 長官が健康・ヒューマンサービス長官の協力を得て、規則によって本法の執行のために、又は労働災害及び疾病の原因及び予防に関する情報の作成のために、必要又は適切であると規定した場合、各事業者は本法に関連する自己の活動に関する記録を作成、保持、保管し、長官又は健康・ヒューマンサービス長官に提出するものとする。本項の規定を実行する場合、かかる規則には事業者に定期的な検査を行わせる規定を含むことができる。長官はまた、事業者に掲示又はその他の適切な手段によって、その労働者に本法に基づく保護と義務を、該当する基準の規定を含めて理解させることを義務づける規則を制定するものとする。

(c)(1) Each employer shall make, keep and
preserve, and make available to the Secretary
or the Secretary of Health and Human Services,
such records regarding his activities relating
to this Act as the Secretary, in cooperation
with the Secretary of Health and Human Services,may
prescribe by regulation as necessary or appropriate
for the enforcement of this Act or for developing
information regarding the causes and prevention
of occupational accidents and illnesses.
In order to carry out the provisions of this
paragraph such regulations may include provisions
requiring employers to conduct periodic inspections.
The Secretary shall also issue regulations
requiring that employers, through posting
of notices or other appropriate means, keep
their employees informed of their protections
and obligations under this Act, including
the provisions of applicable standards.

(2) 長官は健康・ヒューマンサービス長官の協力を得て、労働関連の死亡、負傷、疾病の正確な記録を作成し、定期的な報告を行うことを事業者に義務づける規則を制定するものとする。ただし救急措置のみを必要とし、医学的治療、意識の喪失、作業又は運動の制限、別の職務への配転などを伴わないものは除かれる。

(2) The Secretary, in cooperation with the
Secretary of Health, Education and Welfare, shall prescribe regulations
requiring employers to maintain accurate records of, and to make periodic
reports on, work-related deaths, injuries and illnesses other than minor
injuries requiring only first aid treatment and which do not involve medical
treatment, loss of consciousness, restriction of work or motion, or transfer
to another job.

(3) 長官は健康・ヒューマンサービス長官の協力を得て、事業者に第6条に基づいて監視又は測定しなければならない、潜在的な有毒物質又は危険な薬品に対する、労働者の暴露の正確な記録を維持することを義務づける規則を制定するものとする。かかる規則は、労働者又はその代表者にかかる監視又は測定を観察し、その記録を見る機会を与えるものとする。またかかる規則は、各労働者又は各元労働者に、自分の有毒物質又は危険な薬品との暴露を示すような記録を見る機会を与えるものとする。各事業者は、第6条に基づいて公布された該当労働安全衛生基準が規定する濃度又はレベルを超える有毒物質又は危険な薬品に、暴露された又は暴露されているあらゆる労働者に、そのことをすみやかに通知し、またそれらの労働者に是正措置が取られたことを通知するものとする。

(3) The Secretary, in cooperation with the
Secretary of Health and Human Services, shall
issue regulations requiring employers to
maintain accurate records of employee exposures
to potentially toxic materials or harmful
physical agents which are required to be
monitored or measured under section 6. Such
regulations shall provide employees or their
representatives with an opportunity to observe
such monitoring or measuring, and to have
access to the records thereof. Such regulations
shall also make appropriate provision for
each employee or former employee to have
access to such records as will indicate his
own exposure to toxic materials or harmful
physical agents. Each employer shall promptly
notify any employee who has been or is being
exposed to toxic materials or harmful physical
agents in concentrations or at levels which
exceed those prescribed by an applicable
occupational safety and health standard promulgated
under section 6, and shall inform any employee
who is being thus exposed of the corrective
action being taken.

(d) 本法に基づき長官、健康・ヒューマンサービス長官、又は州政府機関が情報を入手する場合には、事業者、特に小企業経営者にできるだけ負担をかけないように配慮しなければならない。情報入手のために無用な努力を重複させることは、最小限にしなければならない。

(d) Any information obtained by the Secretary,
the Secretary of Health, Education and Welfare, or a State agency under
this Act shall be obtained with a minimum burden upon employers, especially
those operating small businesses. Unnecessary duplication of efforts in
obtaining information shall be reduced to the maximum extent feasible.
|
(e) 長官が定める規則に従い、事業者の代表者及び労働者の正式代表者は、本法に基づく(a)項の作業場の検査が行われる際には、検査を助けるために長官又はその正式代表者に同伴する機会を与えられるものとする。労働者の正式代表者がいない場合、長官又はその正式代表者は作業場の安全衛生事項について妥当な数の労働者と協議するものとする。

(e) Subject to regulations issued by the
Secretary, a representative of the employer and a representative authorized
by his employees shall be given an opportunity to accompany the Secretary
or his authorized representative during the physical inspection of any
workplace under subsection (a) for the purpose of aiding such inspection.
Where there is no authorized employee representative, the Secretary or
his authorized representative shall consult with a reasonable number of
employees concerning matters of health and safety in the workplace.

(f)(1) 労働者又は労働者代表者が、安全又は衛生基準が侵害され、身体的な危害の恐れがあり、又は危険が切迫していると考えた場合、それらの者は長官又はその正式代表者にかかる侵害又は危険を通知し、検査を求めることができる。このような通知は書面に記載し、通知の根拠を妥当に説明し、労働者又はその代表者が署名し、その写しを検査の時までに事業者又はその代理人に提出するものとする。ただし通知を行った者が要求した場合、その者の氏名、通知に記載された者の氏名などは、写しや本条(g)項に基づいて公表される記録には記載されないものとする。長官がこのような要求を受理し、かかる侵害や危険の存在を信じるに足りる妥当な理由があると判断した場合、長官はできるだけ早く本条の規定に従って特別検査を実施し、かかる侵害又は危険が存在するかどうかを確認するものとする。長官がかかる侵害や危険の存在を信じるに足りる妥当な理由がないと判断した場合、その決定を労働者又はその代表者に書面で通知しなければならない。

(f)(1) Any employees or representative of
employees who believe that a violation of a safety or health standard
exists that threatens physical harm, or that an imminent danger exists,
may request an inspection by giving notice to the Secretary or his authorized
representative of such violation or danger. Any such notice shall be reduced
to writing, shall set forth with reasonable particularity the grounds
for the notice, and shall be signed by the employees or representative
of employees, and a copy shall be provided the employer or his agent no
later than at the time of inspection, except that, upon the request of
the person giving such notice, his name and the names of individual employees
referred to therein shall not appear in such copy or on any record published,
released, or made available pursuant to subsection (g) of this section.
If upon receipt of such notification the Secretary determines there are
reasonable grounds to believe that such violation or danger exists, he
shall make a special inspection in accordance with the provisions of this
section as soon as practicable, to determine if such violation or danger
exists. If the Secretary determines there are no reasonable grounds to
believe that a violation or danger exists he shall notify the employees
or representative of the employees in writing of such determination.

(2) 作業場の検査に先立ち又は検査の間、その作業場に雇用されている労働者又はその代表者は、検査を実施する長官又はその正式代表者に、その作業場に存在すると信じる本法の違反を書面で通知することができる。長官は規則に基づき、長官の代表者が侵害の主張について警告書の発行を拒否した場合、それを非公式に審査する手続きを定め、さらに審査を請求した労働者又はその代表者に、長官による事件の最終的な決定の理由を告げる書面を与えるものとする。

(2) Prior to or during any inspection of
a workplace, any employees or representative of employees employed in
such workplace may notify the Secretary or any representative of the Secretary
responsible for conducting the inspection, in writing, of any violation
of this Act which they have reason to believe exists in such workplace.
The Secretary shall, by regulation, establish procedures for informal
review of any refusal by a representative of the Secretary to issue a
citation with respect to any such alleged violation and shall furnish
the employees or representative of employees requesting such review a
written statement of the reasons for the Secretary's final disposition
of the case.

(g)(1) 長官及び健康・ヒューマンサービス長官は、本条に基づいて取得したすべての報告書又は情報を、要約又は詳細な形式で編集、分析、公表する権限を有する。

(g)(1) The Secretary and Secretary of Health
and Human Services are authorized to compile,
analyze, and publish, either in summary or
detailed form, all reports or information
obtained under this section.
|
(2) 長官及び健康・ヒューマンサービス長官は、本法に基づくその責任を遂行するために必要と考える、規定、規則をそれぞれ制定することができる。その規定、規則には事業者の施設の検査に関する規定、規則が含まれる。
|
|
(2) The Secretary and the Secretary of Health
and Human Services shall each prescribe such
rules and regulations as he may deem necessary
to carry out their responsibilities under
this Act, including rules and regulations
dealing with the inspection of an employer's
establishment.
|
(h)長官は、発行した警告数、罰金の評価額など、法執行により得られた結果を、本法の執行に直接携わる担当官を評価することに使ってはならない。また執行に当たってこれらの割り当て数や目標を課するために使ってはならない。
|
|
(h) The Secretary shall not use the results
of enforcement activities, such as the number of citations issued or penalties
assessed, to evaluate employees directly involved in enforcement activities
under this Act or to impose quotas or goals with regard to the results
of such activities.
