12. The Occupational Safety
and Health Review Commission
|
(a) 本法に基づき、労働安全衛生審査委員会を設立する。審査委員会は上院の助言と同意により、訓練、教育、経験などの理由により、本法に基づく審査委員会の職務遂行の資格を持つ人物の中から大統領が任命した3人の委員によって構成される。大統領は委員の一人を委員長に任命する。

(a) The Occupational Safety and Health Review
Commission is hereby established. The Commission shall be composed of
three members who shall be appointed by the President, by and with the
advice and consent of the Senate, from among persons who by reason of
training, education, or experience are qualified to carry out the functions
of the Commission under this Act. The President shall designate one of
the members of the Commission to serve as Chairman.

(b) 審査委員会委員の任期は6年とする。ただし、(1) 審査委員会に最初に就任する委員のうち、大統領が任命の際に指定した一人は任期2年、一人は4年、一人は6年とする。(2)
任命された任期の満了前に死亡、辞任、解任などのために生じた空席は、残る任期についてのみ補充される。大統領は非効率、義務の怠慢、職務不履行などの理由により、委員を解任することができる。

(b) The terms of members of the Commission
shall be six years except that (1) the members of the Commission first
taking office shall serve, as designated by the President at the time
of appointment, one for a term of two years, one for a term of four years,
and one for a term of six years, and (2) a vacancy caused by the death,
resignation, or removal of a member prior to the expiration of the term
for which he was appointed shall be filled only for the remainder of such
unexpired term. A member of the Commission may be removed by the President
for inefficiency, neglect of duty, or malfeasance in office.

(d) 審査委員会の主たる事務所はコロンビア特別区に置く。審査委員会が公衆の又は関係当事者の便宜をはかり、遅延や出費を抑えるために必要であると考えた場合には、他の場所で審問又はその他の手続きを実施することができる。

(d) The principal office of the Commission
shall be in the District of Columbia. Whenever the Commission deems that
the convenience of the public or of the parties may be promoted, or delay
or expense may be minimized, it may hold hearings or conduct other proceedings
at any other place.
|
(e) 委員長は審査委員会の管理運営の責任を負い、審査委員会の職務を支援するために必要と思われる審問官その他の職員を任命し、アメリカ合衆国法典第5巻第51章及び第53章III項の規定(区分と一般日程報酬率)に従い、その報酬を決定する。ただし、審問官の任命、解任、報酬はアメリカ合衆国法典第5巻第3105、3344、5362、7521各節によるものとする。

(e) The Chairman shall be responsible on
behalf of the Commission for the administrative operations of the Commission
and shall appoint such administrative law judges and other employees as
he deems necessary to assist in the performance of the Commission's functions
and to fix their compensation in accordance with the provisions of chapter
51 and subchapter III of chapter 53 of title 5, United States Code, relating
to classification and General Schedule pay rates: Provided, That assignment,
removal and compensation of administrative law judges shall be in accordance
with sections 3105, 3344, 5362, and 7521 of title 5, United States Code.

(f) 本法に基づくその職務を執行するため、審査委員会は2名の委員をもって定数とし、最低2名の賛成投票がなければ、正式の決定はできないものとする。

(f) For the purpose of carrying out its functions
under this Act, two members of the Commission shall constitute a quorum
and official action can be taken only on the affirmative vote of at least
two members.
|
(g) 審査委員会のあらゆる正式決定は記録にとどめ、その審問及び記録は一般に公開される。審査委員会はその手続きの規律正しい履行のために必要な規則を制定することができる。審査委員会が別の規則を採択しない限り、その手続きは連邦民事手続き規則によるものとする。

(g) Every official act of the Commission
shall be entered of record, and its hearings and records shall be open
to the public. The Commission is authorized to make such rules as are
necessary for the orderly transaction of its proceedings. Unless the Commission
has adopted a different rule, its proceedings shall be in accordance with
the Federal Rules of Civil Procedure.

(h) 審査委員会はそのあらゆる手続きの段階において、証言を宣誓証書にすることを命じることができる。審査委員会において証人が出頭、証言、証拠の提示を義務づけられるのと同様に、審査委員会はあらゆる人物に出頭、証言し、書籍、文書、書類などの提示を義務づけることができる。本項に基づいて宣誓証書が作成された証人は、アメリカ合衆国裁判所での役務に対する場合と同様の報酬を受けることができる。

(h) The Commission may order testimony to
be taken by deposition in any proceedings pending before it at any state
of such proceeding. Any person may be compelled to appear and depose,
and to produce books, papers, or documents, in the same manner as witnesses
may be compelled to appear and testify and produce like documentary evidence
before the Commission. Witnesses whose depositions are taken under this
subsection, and the persons taking such depositions, shall be entitled
to the same fees as are paid for like services in the courts of the United
States.

(i) 審査委員会のあらゆる手続きの目的上、国家労働関係法(29USC 161)第11節の規定は、審査委員会の管轄権と権限に適用されるものとする。

(i) For the purpose of any proceeding before
the Commission, the provisions of section 11 of the National Labor Relations
Act (29 U.S.C. 161) are hereby made applicable to the jurisdiction and
powers of the Commission.

(j) 審査委員会に任命された審問官は、審査委員会委員長がそれに割り当てたあらゆる審査委員会の手続き及びそれに関連するあらゆる命令申請を聴取し、決定を下すとともに、その最終的手続き処理を構成する決定の報告書を作成するものとする。審問官の報告書は、その作成から30日以内に、委員がそれの審査委員会による審査を要求しない限り、審査委員会の最終的命令となるものとする。

(j) A administrative law judge appointed
by the Commission shall hear, and make a determination upon, any proceeding
instituted before the Commission and any motion in connection therewith,
assigned to such administrative law judge by the Chairman of the Commission,
and shall make a report of any such determination which constitutes his
final disposition of the proceedings. The report of the administrative
law judge shall become the final order of the Commission within thirty
days after such report by the administrative law judge, unless within
such period any Commission member has directed that such report shall
be reviewed by the Commission.

(k) 本法に別段の規定がある場合を除き、審問官は機密行政事務の職員に対する法律の適用を受ける。ただし、その任命はアメリカ合衆国法典第5巻第5108節とは関わりなく行われるものとする。各審問官はアメリカ合衆国法典第5巻第5332節に基づくGS-16に規定する以上の報酬を受ける。

(k) Except as otherwise provided in this
Act, the administrative law judges shall be subject to the laws governing
employees in the classified civil service, except that appointments shall
be made without regard to section 5108 of title 5, United States Code.
Each administrative law judge shall receive compensation at a rate not
less than that prescribed for GS-16 under section 5332 of title 5, United
States Code.
