26. Annual Report
|
各議会の定期会期の招集から120日以内に、長官及び健康・ヒューマンサービス長官はそれぞれ、本法の主題事項、本法の目的達成に向かっての進展、労働安全衛生分野でのニーズと要件、その他関連する情報を記載した報告書を大統領に提出、議会に送付するものとする。これらの報告書に含まれるべきものは、前年に作成された労働安全衛生基準に関する情報、かかる基準のための標準;本法に基づいて過去に作成された基準、標準の評価と新しい標準、基準のために重視すべき領域;労働安全衛生基準の遵守状況と実施された検査及び執行の概要;政府又は政府外の支援によって得られた研究活動の成果の評価と分析;主要な職業病の分析;前年中に基準、標準が作成された危険についての管理、測定技術の評価;前年中に本法の実施において政府機関と他の関係当事者との間に行われた協力作業の状況;労働安全衛生分野の訓練を受けた要員の十分な供給の開発に関する進展報告(将来のニーズとそのために政府機関や他の当事者が払った努力を含む);ラベル表示要件、標準、基準がまだ設定されていない産業用のすべての有毒物質のリスト;労働者の安全衛生を保護し、本法の運用管理を改善するために必要な新たな立法に関する勧告などである。

Within one hundred and twenty days following
the convening of each regular session of
each Congress, the Secretary and the Secretary
of Health and Human Services shall each prepare
and submit to the President for transmittal
to the Congress a report upon the subject
matter of this Act, the progress toward achievement
of the purpose of this Act, the needs and
requirements in the field of occupational
safety and health, and any other relevant
information. Such reports shall include information
regarding occupational safety and health
standards, and criteria for such standards,
developed during the preceding year; evaluation
of standards and criteria previously developed
under this Act, defining areas of emphasis
for new criteria and standards; an evaluation
of the degree of observance of applicable
occupational safety and health standards,
and a summary of inspection and enforcement
activity undertaken; analysis and evaluation
of research activities for which results
have been obtained under governmental and
nongovernmental sponsorship; an analysis
of major occupational diseases; evaluation
of available control and measurement technology
for hazards for which standards or criteria
have been developed during the preceding
year; description of cooperative efforts
undertaken between Government agencies and
other interested parties in the implementation
of this Act during the preceding year; a
progress report on the development of an
adequate supply of trained manpower in the
field of occupational safety and health,
including estimates of future needs and the
efforts being made by Government and others
to meet those needs; listing of all toxic
substances in industrial usage for which
labeling requirements, criteria, or standards
have not yet been established; and such recommendations
for additional legislation as are deemed
necessary to protect the safety and health
of the worker and improve the administration
of this Act.
